Garnishing Bank Accounts: When a payment is received from the bank that does not satisfy the judgement in full, you must refile in your local court. If you are garnishing wages or bank account, you may receive payment or a letter within 4 to 6 weeks.

When submitting paperwork to the Constable's office we require the following:  The Constable fee, 1 Instruction to the Constable, 1 Notice of Execution after Judgement, 3 Writs of Execution filed with the Court, 2 Writs of Garnishments, a $5.00 check made payable to the employer or bank, a self-addressed stamped envelope to the Defendant, if paperwork needs to be mailed please include another self-addressed stamped envelope to the employer/bank or increase our Constable fee by $2.00. Garnishing Wages: The employer has 20 days to respond to the interrogatory. If we do not receive a response, we do not follow-up since we are unable to force the employer to respond. It is up to you to follow-up on your case if you haven't received payment or a letter within 4 to 6 weeks.

All Executions/Garnishments expire after 180 days. If your judgment is not satisfied within the 180 days, you may refile your Execution/Garnishment in your local Court.

The maximum legal amount of a wage garnishment is 25 percent of the take home pay. However, it is up to the employer to determine the amount of net pay to be garnished from the defendants paycheck.

The following are reasons why you may not receive funds from a wage garnishment:

  • Defendant has a prior garnishment
  • Defendant does not make enough money to garnish
  • Defendant has a child support or IRS levy
