If you wish to apply for a protection order, you must first determine the type of protection order you are seeking and then file the applicable application with the court that has jurisdiction over the matter.
Domestic Violence Protection Order: A domestic violence protection order is against someone with which:
• You have a child or children in common;
• You are married or were married;
• You are related by blood (not including siblings and cousins) or marriage; or
• You are dating or were in a dating relationship.
In Clark County, Domestic Violence Protection Orders are issued by the Family Court Division of the Eighth Judicial District Court. Henderson Justice Court does not issue Domestic Violence Protection Orders.
Stalking, Aggravated Stalking, Harassment, Sexual Assault, and Protection of Children Protection Order: A stalking, aggravated stalking or harassment protection order application may be filed in Henderson Justice Court if the incidents occurred in Henderson Township or if the person affected by the conduct was in Henderson Township at the time the conduct occurred. If you wish to apply for such an order, you must file an Application for a Temporary Order for Protection. The application and any accompanying videos, pictures, or documents must be filed in-person or via postal mail.
At the time of filing the Application for a Temporary Order for Protection, provide copies of any pictures, text messages, emails, police reports, etc. on 8½in. x 11in. standard paper. Additionally, videos must be saved and filed with the court on a removable portable storage device and stored in a format supported by Windows Media Player. Videos, pictures, and electronic documents will not be accepted via email.
Applications that are received after 4:00PM will not be reviewed until the following judicial day.
Harassment in the Workplace Protection Order: Only the employer of a business or the authorized agent (such as an attorney for the business) may apply for a Harassment in the Workplace Protection Order. If you are an employee being harassed in the workplace, your employer must apply for this type of protection order, or you must file a different type of protection order on your own behalf (e.g., Stalking, Aggravated Stalking, Harassment Protection Order).
If you wish to apply for such an order, you must file an Application for a Temporary Order for Protection Against Harassment in the Workplace. Unlike other types of protection orders, there is a bond required at the time of filing. The application and any accompanying videos, pictures, or documents must be filed in-person or via postal mail. At the time of filing the Application for a Temporary Order for Protection, provide copies of any pictures, text messages, emails, police reports, etc. on standard 8½in. x 11in. white paper. Additionally, videos must be saved and filed with the court on a removable portable storage device and stored in a format supported by Windows Media Player. Videos, pictures, and electronic documents will not be accepted via email.

If you were granted a Temporary Protection Order, and the adverse party was served with the order, you may apply to extend the protection order. Before the expiration of your Temporary Protection Order, you may file a Motion to Extend Protection Order. The motion must be filed in-person or via postal mail. Upon filing a motion, and requesting an extended order, the court will schedule a hearing. The court clerk will generate a Notice of Hearing that must be served on the adverse party.
Once a Temporary Protection Order is granted, and before it expires, either party may file a motion asking the court to “dissolve” (i.e., cancel) the protection order. If you would like to ask the judge to dissolve the protection order, you may file a Motion to Dissolve Protection Order. The motion and any accompanying videos, pictures, or documents must be filed in-person or via postal mail. Videos, pictures, and electronic documents will not be accepted via email.
